Opinions of the Ministry of Transport on Comprehensively Strengthening the Safety Production of Hazardous Chemical Transportation

The transportation departments (bureaus and committees), subordinate units and departments within the Ministry of Transport of all provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps:

In order to conscientiously implement the requirements of the Opinions of the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council on Comprehensively Strengthening the Work of Safe Production of Hazardous Chemicals, deeply absorb the lessons of major accidents in the field of hazardous chemicals, draw inferences from one instance, and comprehensively strengthen the work of safe production of hazardous chemicals transportation, the following opinions are proposed:

1、 Overall requirements

Regional safety production risk prevention and control, strict implementation of safety production responsibility and management system, improvement of hidden danger investigation and safety production prevention and control system, strengthening source management, comprehensive management, and precise management, strengthening the entire chain safety management of hazardous chemical transportation, consolidating the foundation of safety development, comprehensively improving the level of safety development, and resolutely curbing the occurrence of major accidents in the safety production of hazardous chemical transportation, Promote the continuous and stable improvement of transportation safety production situation, and create a safe and stable environment for economic and social development.

2、 Strengthen safety production risk control

(1) Strengthen risk prevention and control. Establish a sound risk management system and standard specifications, and establish a comprehensive, operational, and implementable long-term mechanism. Strictly implement risk control responsibilities, organize and implement precise safety risk screening and assessment for dangerous goods transport enterprises and port hazardous chemicals concentration areas, and implement precise control. Implement hierarchical management of identified risks and strictly implement a major risk reporting system. Major risks are strictly monitored and controlled throughout the entire process, with "one enterprise, one policy" and "one case, one case".

(2) Strengthen the investigation and management of hidden dangers. In accordance with relevant institutional norms such as the "Guidelines for the Investigation and Management of Safety Risk Hazards in Hazardous Chemical Enterprises", we will comprehensively carry out safety production hazard investigation, strengthen the transportation of high-risk goods such as highly toxic chemicals, explosives, and radioactive substances, and conduct safety hazard investigation for major hazard sources. We will implement "one case, one handling" and "special person supervision" for major hazards, and carry out legislative reforms to ensure safety.

(3) Deeply draw lessons from typical accidents. Carefully draw lessons from typical hazardous chemical accidents such as the "3.21" incident in Xiangshui, compare industry safety production responsibilities, sort out existing weak links and loopholes, identify and fill in deficiencies, further improve the institutional system, strengthen monitoring of key areas and parts, and strengthen the implementation of various control measures. Conduct a review of the rectification of hidden dangers in hazardous chemical safety production accidents, evaluate the effectiveness of the rectification, and ensure that all rectification measures achieve the expected results.

(4) Deepen special rectification actions. In conjunction with the three-year action plan for the national special rectification of safety production, we will deepen the safety management of in-service hazardous chemical storage tanks in ports, and carry out actions such as the special management of atmospheric pressure liquid dangerous goods tank trucks. Strictly crack down on illegal and irregular transportation of dangerous goods on roads and waterways, with a focus on cracking down on unlicensed and beyond scope operations.

(5) Strengthen monitoring, early warning, and emergency preparedness. Strengthen the monitoring, warning, and emergency preparedness of major safety risks in the industry, develop monitoring and control measures for major risks, key locations, and key links of hazardous chemical road and waterway transportation, port storage, and loading and unloading operations, achieve dynamic monitoring of risk factors, timely grasp the risk status, and issue risk warnings. To address major risks and hidden dangers, improve emergency measures, implement emergency supplies and personnel preparation, and ensure that all emergency preparedness measures are in place.

3、 Strengthen the safety production management of the entire chain

(6) Strict admission management. Strict access for road and waterway transportation of dangerous goods, as well as port loading and unloading and storage operations. Strengthen the access management of dangerous goods transportation vehicles and vessels, and strictly use vehicles, vessels, and equipment that meet the safety technical requirements of national standards and match the nature and weight of the dangerous goods carried. Strictly implement the "safety three simultaneities" and safety condition review system for new construction, renovation, and expansion of hazardous chemical port construction projects. Strictly manage the admission of employees, and drivers, crew members, loading and unloading management personnel, escorts, declaration personnel, and container on-site inspectors of hazardous chemical road and waterway transportation enterprises shall obtain professional qualifications in accordance with the law.

(7) Strengthen safety control of key links. Strictly implement the "Measures for the Safety Management of Road Transport of Dangerous Goods", cooperate with relevant departments, and strengthen the safety supervision of the entire chain of road transport of dangerous goods such as consignment, transportation, loading and unloading, and vehicle operation in accordance with the law and responsibilities. Cooperate with the State Administration for Market Regulation to formulate and publish the directory of inspection institutions and inspection business rules for atmospheric pressure liquid dangerous goods tank vehicles. Research and establish a mandatory inspection system for atmospheric dangerous goods storage tanks. Strengthen the safety management of hazardous chemical storage facilities such as port yards, warehouses, and tank farms within the scope of industry responsibilities. Strictly supervise the safety of dangerous chemical ship loading and unloading, cabin washing, lightering and other operations. Guide the expressway experience management unit to do a good job in guiding the temporary parking of dangerous goods transport vehicles according to the designated location in the qualified expressway service area. Strictly control the navigation of dangerous goods transport ships in lock hubs, drinking water sources, nature reserves, and bridge areas, and prohibit ships from navigating within designated restricted areas.

(8) Strengthen safety supervision during and after the incident. Urge dangerous goods road transportation enterprises to conscientiously implement the dynamic supervision system for dangerous goods transportation vehicles, and strengthen the supervision of vehicle operation and drivers. The monitoring and control of hazardous chemical workplaces in ports should be fully covered, and the monitoring of hazardous chemical storage tanks should be strengthened. The equipment rate of automatic control systems for storage and transportation facilities involving key regulated hazardous chemicals and major hazardous sources of hazardous chemicals, as well as the online monitoring and control rate of major hazardous sources, should reach 100%. Strengthen the safety management of hazardous chemical workplaces in ports, and strictly implement various management systems for special operations. Actively promote the electronic declaration of dangerous chemicals ships entering and leaving the port, strictly enforce the declaration management of dangerous chemicals carried by ships and the safety management of crossing the gate, strengthen the information notification between management departments, and strictly implement the ship shore safety inspection system before the loading and unloading of dangerous chemicals. Strengthen the daily supervision of enterprises and strengthen the supervision and management of system operation. Cooperate with ecological and environmental departments to jointly promote the interconnection and exchange of information on electronic waybills for hazardous goods and hazardous waste transfer documents, and form a regulatory system for the entire process of hazardous waste.

(9) Strengthen emergency response and accident accountability. Coordinate professional rescue forces for dangerous goods transportation, encourage industry associations and dangerous goods transportation enterprise alliances to establish a network mutual assistance rescue system, and establish regional emergency rescue teams. Strengthen the construction of emergency response capabilities for hazardous chemicals on the Yangtze River trunk line, with a focus on promoting the construction of regional rescue bases. The Nanjing base highlights the characteristics of emergency response for hazardous chemical transportation. Strengthen the allocation of emergency rescue equipment, improve emergency rescue plans, promote the integration of port emergency plans into the urban emergency plan system, carry out practical training exercises, and improve regional collaborative rescue capabilities. Strengthen research on the construction of emergency response capabilities for dangerous goods transportation, develop emergency guidelines for dangerous goods transportation accidents, and guide enterprises to improve their emergency response capabilities. Serious accident handling, in accordance with the principle of "four not letting go", and strict accountability for accidents.

4、 Strengthen the implementation of corporate main responsibilities

(10) Strengthen safety production supervision, inspection, and law enforcement. Deeply carry out supervision and inspection, with a focus on checking the implementation of the main responsibilities of enterprise safety production. Actively cooperate with the competent departments of the hazardous chemical production and operation industry to strictly investigate and punish the illegal commission of dangerous goods by consignors of dangerous goods to enterprises (vehicles, ships) that do not have the qualifications for transporting dangerous goods. It is strictly prohibited for passenger vehicles and ships to illegally carry dangerous goods, and enterprises (vehicles, ships) and employees engaged in illegal and irregular transportation of dangerous goods shall be severely investigated and punished in accordance with the law and regulations. Urge dangerous goods transportation enterprises to develop emergency rescue plans for accidents, equip emergency rescue personnel and necessary emergency rescue equipment, and regularly organize drills. Strictly supervise the establishment of a safety and security system by the legal representative of the operating and management unit at various hazardous chemical ports and docks along the Yangtze River trunk line, and conduct safety inspections on ships intending to enter the controlled area of the Three Gorges Hub's safety and security zone in accordance with the law.
